Sanchar Nest Ordered to Refund Rs 79 Lakh to Homebuyers After 15-Year Delay

The Delhi Consumer Commission has ordered real estate developer Sanchar Nest Sahakari Awas Samiti Ltd to refund Rs 79.43 lakh and pay Rs 5 lakh in compensation to two homebuyers after a 15-year legal battle over a delayed housing project originally launched in Noida. The housing project, Palm Wood Enclave, was later relocated to Wave City in Ghaziabad following land disputes.
The ruling brings an end to a long-standing dispute that began in 2010 when the two families booked 3BHK apartments in the development. The buyers were originally promised possession of their homes by 2012, but they ultimately spent 15 years waiting for the project to be completed.
The project was initially launched in Noida, but after alleged land disputes, the developer shifted the site to Ghaziabad. Fresh agreements were signed by the buyers in 2013. Despite these new agreements, the project, which comprises 506 flats across three towers, remained incomplete.
This month, the Delhi Consumer Commission ruled in favor of the buyers. The commission directed Sanchar Nest Sahakari Awas Samiti Ltd, a cooperative society, to refund the Rs 79.43 lakh and pay an additional Rs 5 lakh to cover litigation costs and compensation for mental agony.
One of the homebuyers expressed relief after the ruling, stating that the judgment represents closure, relief, and justice after years of uncertainty. The homebuyer noted that the family had invested their savings into the project with dreams of moving into their own home and building a stable future, only to have those plans repeatedly postponed.
Another buyer shared similar frustrations, explaining that their money remained locked in the incomplete project for years while they continued to bear other living expenses and financial obligations.
The project still lacks essential infrastructure. According to the Uttar Pradesh Real Estate Regulatory Authority (UP RERA) portal, development works such as road construction, water supply, and sewer systems are still active and listed as "BEING DONE." The portal also indicates that there are currently 23 complaints registered against this specific housing project.
