Gurgaon Couple Alleges Embryo Swap At Greater Kailash IVF Clinic After Birth Of Twins

A Gurgaon couple has accused a fertility clinic in Greater Kailash, New Delhi, of swapping their embryos without consent during an IVF procedure, resulting in the birth of twin girls in January 2026 who are not biologically related to them. The allegations have triggered investigations by the Union Health Ministry and the Delhi Government's Assisted Reproductive Technology (ART) and Surrogacy department, alongside ongoing police and judicial proceedings.

The complaint was filed by Gurgaon resident Rahul Rathore and his wife, Meenu, against SCI IVF Hospital. The couple alleges that they never discussed or consented to using donor embryos. According to Rathore, the clinic repeatedly assured them throughout the treatment that the embryos transferred were created using his sperm and his wife’s eggs. The couple discovered the twins were not biologically related to them through DNA testing.

In response, Dr. Vishal Gaur of SCI IVF Hospital defended the clinic, maintaining that the couple voluntarily opted for donor-gamete treatment. He stated that the clinic followed the Assisted Reproductive Technology (Regulation) Act and that all statutory consent requirements were fulfilled and signed before the procedure.

Dr. Gaur also disputed the family’s medical history, claiming the couple had a history of secondary infertility, previous failed IVF attempts, and abortions before approaching the clinic. He further alleged that Rathore’s behaviour changed after the birth of the twins because he was angry about having twin daughters, and that Rathore later misbehaved with the hospital staff.

Rathore has rejected the hospital's claims entirely, calling them incorrect and misleading. He stated there was no history of abortions and that they chose IVF solely due to a 10-year gap between their first and second child. Rathore also denied being unhappy about having daughters, noting that he is a proud father of four daughters.

The dispute has led to parallel legal and administrative actions. The Union Health Ministry recently urged the Delhi government's ART department to treat the matter with utmost priority and verify consent forms, donor records, and statutory compliance. However, the Delhi ART authority has kept its proceedings in abeyance, citing the ongoing police investigation and pending judicial proceedings.

Additionally, in June, the Saket court dismissed a revision petition filed by the hospital that challenged an earlier order directing the registration of an FIR.
