Delhi High Court grants bail to two accused of assaulting YouTube reporters in Seemapuri

The Delhi High Court on July 16, 2026, granted bail to two individuals accused of assaulting two freelance YouTube reporters in Delhi's Seemapuri area. The incident, which occurred on July 4, 2025, involved a mob attacking the reporters while they were filming a video at a local place of worship. Justice Girish Kathpalia, while granting bail, observed that unaccredited freelance content creators lack the training, ethics, and accountability of professional journalists.

According to court records, the two reporters were recording a video about a place of worship in Seemapuri that was allegedly constructed without authorisation. The recording agitated local residents, who then chased the reporters. The reporters boarded a bus to escape, but the mob, which allegedly included the two accused, entered the vehicle and assaulted them.

Justice Kathpalia described the incident as an act of "mass fury" and noted that the involvement of the two accused applicants in the actual assault remained a "grey area," which justified granting them bail.

During the court proceedings, the prosecution argued that the attack on the reporters was an assault on the freedom of the press. However, the court pointed out that the complainants were not associated with any accredited news organisation and were instead freelancing for a YouTube channel.

Justice Kathpalia observed that with the rapid rise of social media and digital platforms, a large section of the media has become unregulated. He noted that it has become common for self-styled reporters to aggressively thrust microphones at citizens and demand instant responses, creating misleading public narratives when citizens choose to remain silent.

While emphasizing that the freedom of the press must be protected, the judge stated that it cannot be used as a shield for irresponsible journalism, intimidation, or content that threatens public order.

The court also noted that the reporters did not take the local police into confidence before starting their recording, despite the sensitive nature of the issue. However, the judge clarified that this did not justify the attack by the agitated locals.

Justice Kathpalia concluded by suggesting that the legislature should consider creating an appropriate regulatory framework to preserve press freedom while ensuring ethical standards and professional accountability.
