Delhi HC Seeks Police Stand On Pinky Irani's Plea Against MCOCA Charges

The Delhi High Court on Wednesday, July 8, 2026, sought the Delhi Police's stance on a petition filed by Pinky Irani, an aide of alleged fraudster Sukesh Chandrasekhar, challenging the framing of charges against her under the stringent Maharashtra Control of Organised Crime Act (MCOCA) in a ₹200 crore extortion case.

Justice Madhu Jain issued a notice to the Delhi Police on Irani's revision petition, which challenges the legal basis of the MCOCA charges. The high court granted the investigating agency a period of two weeks to file its formal response to the petition.

The revision petition assails a trial court order passed on June 3, 2026. In that order, the trial court had framed charges against Chandrasekhar, Irani, and 19 other individuals for various offences, including provisions under the stringent MCOCA.

During the High Court proceedings, Irani's counsel argued that she had been wrongly charged in the extortion case. The counsel asserted that there was no legal basis to sustain the MCOCA provisions against her. He submitted to the court that MCOCA could only be invoked when there is involvement in an Indian Penal Code (IPC) offence, which he stated was admittedly not the case for Irani. MCOCA is a specialized law enacted in 1999 to combat organised crime syndicates and terrorism.

A senior counsel representing the Delhi Police opposed Irani's petition during the hearing and sought time from the court to file a response.

The Delhi Police's charge sheet in the case alleges that Irani used to portray Chandrasekhar as a business tycoon. The police also alleged that she was instrumental in facilitating Chandrasekhar's meetings with certain Bollywood personalities.

Chandrasekhar, who is currently lodged in jail, is accused of cheating many people, including high-profile individuals such as Aditi Singh, the wife of former Fortis Healthcare promoter Shivinder Mohan Singh.

The Delhi High Court had previously granted bail to Irani in connection with this extortion case on October 20, 2023.
