NGT Disposes of Plea Challenging Bijwasan Rail Project Construction in Dwarka

The National Green Tribunal has disposed of a plea challenging construction work on approximately 95 acres of land earmarked for the Bijwasan rail project in Dwarka. The green panel ruled that the matter stood covered by a Supreme Court judgement concerning the same project site.

The application, moved by petitioner Naveen Solanki, had challenged the project by questioning whether the 95 acres of land fell within the classification of "deemed forest." The petitioner contended that the area required statutory protection under the Van (Sanrakshan Evam Samvardhan) Adhiniyam, 1980.

According to the plea, the disputed 95-acre tract formed part of a broader 125-acre forest land parcel. The applicant had also alleged that roughly 13,000 trees were spread across the 95-acre area and raised allegations regarding the illegal felling of trees on the site.

In its observations, the tribunal noted that the 95 acres under dispute were part of a larger 125-acre parcel. The remaining 30 acres of the land tract had already been examined by the tribunal during an earlier proceeding.

The tribunal further pointed out that the Supreme Court, in a judgement dated March 20, 2026, affirmed the earlier order of the tribunal and took into account the entirety of the project land.

The Supreme Court found that the subject land formed part of a larger tract of agricultural land acquired in 1986. The land was subsequently allotted for the development of the Bijwasan Integrated Passenger Terminal and formally incorporated into the Master Plan 2021.
