Two Mahendra Park Cops Face Inquiry for Assaulting Advocate Over Bike Release

A departmental inquiry and a criminal case have been initiated against two Delhi Police head constables for allegedly assaulting an advocate inside the Mahendra Park police station in Northwest Delhi on September 29. The incident occurred around 3:30 pm when the lawyer visited the station to secure the release of his client's impounded motorcycle.

Deputy Commissioner of Police (Northwest) Akanksha Yadav ordered that the two accused officers, identified as Head Constables Ashok and Vijay Dhull, be transferred to the district lines at Ashok Vihar with immediate effect. An Assistant Commissioner of Police-level departmental inquiry has been ordered under the DCP's direct supervision to investigate the conduct of the personnel.

According to the complaint filed by advocate Kamaldeep, he arrived at the Mahendra Park police station with his client to retrieve the motorcycle. Head Constable Ashok allegedly demanded Rs 3,000 to release the vehicle. When Kamaldeep placed a phone call to the station house officer to report the demand, Ashok allegedly began hurling insults at him.

The FIR states that Ashok subsequently returned with several men and attacked Kamaldeep and his associate, Pankaj. Ashok grabbed Kamaldeep by the neck and pulled his gold chain, while Dhull twisted his hand after discovering he was an advocate. The complainant stated that both men were dragged inside the police station and beaten. When Kamaldeep attempted to flee, he was chased, knocked down, struck with sticks and bricks, and bitten on the chest by Ashok, while Dhull assaulted him with a stick.

The assault ended after Kamaldeep dialled the police emergency number, prompting the attackers to flee. Both injured men were taken to Babu Jagjivan Ram Memorial Hospital for medical examination. Kamaldeep's medical report documented an abrasion, a bite mark, and tenderness on the left side of his chest, along with severe pain.

Police registered an FIR based on Kamaldeep's complaint under Bharatiya Nyaya Sanhita sections 115(2) for voluntarily causing hurt, 126(2) for wrongful restraint, and 3(5) for common intention. DCP Yadav confirmed that cross-FIRs have been registered following a counter-complaint from the two head constables, and both matters are being probed on merit.

Following the incident, the Rohini Court Bar Association submitted a formal representation to the DCP seeking strict vigilance action against the accused officers. The bar association requested the preservation and examination of CCTV footage from Mahendra Park police station, an independent inquiry by a senior officer, and the addition of stringent penal sections reflecting the medical evidence.
