Delhi Reconsiders Haryana Parivar Pehchan Model Over Women's Inheritance Rights
The Delhi government is reconsidering key aspects of the Haryana model for implementing the proposed Delhi Parivar Pehchan Act, following concerns that the structure of family records could complicate inheritance matters for married women, officials said on Friday.
The government had earlier planned to adopt Haryana’s Parivar Pehchan Patra framework to create a single, central database of all families residing in the Capital and issue official family cards. The initiative is intended to make it easier for the administration to identify households and streamline access to government welfare schemes and public services. To assess the system, Delhi officials visited Haryana to study the administrative, legal, and technological mechanisms used to maintain and operate the database.
However, officials are not fully convinced that the Haryana model, in its existing form, is compatible with the provisions of the Hindu Succession Act. They are currently examining the framework to ensure that the proposed identity records align with existing laws governing succession and inheritance.
A primary concern involves how a married woman’s family details are documented. Under the Haryana system, a woman’s name is removed from her parental family records and added to her husband’s family after marriage.
Officials noted that this practice could carry implications if a woman later seeks to exercise her legal rights to her father’s property. If her name no longer appears in the parental family records, questions could potentially be raised regarding her relationship with that family during an inheritance claim.
The Delhi government wants to ensure that the consolidated household database does not inadvertently affect an individual’s legal rights or create administrative ambiguity that could be used to contest those rights in the future.
Officials are therefore proposing a modified system where a woman’s name will not be deleted from her father’s family database after marriage. Instead, her name will also be added to her husband’s family record, allowing her to remain eligible for subsidies and welfare benefits from her husband’s side without losing her documented parental ties.
